If there is a Directive applying to a product to be awarded the Eco-label of the Czech Republic, then the applicant shall request the Agency to prepare a license agreement. The applicant shall receive the license agreement together with the Directive and other guidelines. The applicant shall send the completed form together with other documents certifying fulfilment of the requirements specified in the Directive back to the Agency, which shall start the selection procedure. The selection procedure shall last no longer than one month and at the end of the procedure the Agency shall prepare a summary report of the product to be submitted to the Minister of the Environment. Based on the Minister’s approval the Agency shall enter into a license agreement with the applicant granting the applicant the right to use the Environmentally Friendly Product trademark.
If the application is rejected, the Agency shall inform the applicant in writing of the reasons for the refusal. The applicant may apply for the trademark again, but no sooner than six months after the refusal.
Obligations of the eco-label holder:
- the eco-label may be used only on the basis of a licence agreement made between the holder and the Agency,
- the eco-label may be used only monochromatically (black or green), specifying the identification number,
- the eco-label may be used only with products that are subject to the licence agreement,
- the eco-label may be used for advertising only when advertising the product that is subject to the licence agreement; it may not be used for general advertising of the company,
- the eco-label may not be assigned to a third party,
- if possible, the eco-label should be placed on the product; if not, it can be used in a different way upon the agreement with the Agency,
- the holder shall provide correct information regarding the eco-label.
Fees for the Eco-label of the Czech Republic
As of 1 January 2007, the fees for the eco-label have been adjusted for the first time in over 12 years. As before these fees are used to cover the costs of the Agency’s activities in connection with the assessment of applications and the grant of the right to use the trademark and, above all, are intended for the promotion of the eco-label.
A) Obtaining the eco-label Environmentally Friendly Product
1) Registration fee:
the registration fee is CZK 20,000.
Possible discounts:
a) for micro-enterprises 50 %, i.e. CZK 10,000
(note: up to 10 employees)
b) for small and medium-sized enterprises (SME) 25 %, i.e. CZK 15,000
c) for companies which have implemented an environmental management system (registered with EMAS, ISO 14 001 certified), obtained a cleaner production certificate and/or for companies which are currently the holders of an eco-label awarded in accordance with ISO 14 024 (foreign or Czech eco-labels) 15 %, i.e. CZK 17,000.
The discounts may be combined up to the maximum of 50 %.
2) Annual fee CZK 0.
3) Contract extension fee:
a fee has been introduced in the case of extensions of the contract that is granting the right to use the eco-label. The first extension is free of charge, for the second and every consecutive extension the eco-label holder is charged the amount of CZK 2,000. The number of extensions is not limited.
B) Obtaining the eco-label Environmentally Friendly Service
This applies to the categories Tourist accommodation services
and Camp site services
(the category Schools and educational facilities
is subject to specific rules, for more information please contact Environmentally Friendly Products Agency).
1) Registration fee:
the registration fee is CZK 10,000.
Possible discounts:
for micro-enterprises, small and medium-sized enterprises (SME), enterprises registered with EMAS, having obtained an ISO 14 001 certificate, a cleaner production certificate, an eco-label in accordance with ISO 14 024 50 %, i.e. CZK 5,000.
2) Annual fee CZK 5,000.
Possible discounts:
for micro-enterprises, small and medium-sized enterprises (SME), enterprises registered with EMAS, having obtained an ISO 14 001 certificate, a cleaner production certificate, an eco-label pursuant to ISO 14 024 50 %, i.e. CZK 2,500.
The costs for product testing and the preparation of necessary documents are to be paid by the applicant.
As before, when compared to other foreign eco-labelling systems, the Czech programme continues to have the lowest fees. In most other countries additional annual fees, which are calculated as a percentage of the relevant product’s turnover, are collected.
